If eligible, the case pauses while the defendant completes a drug education or treatment program. Successful completion results in the charges being dismissed entirely, with no conviction on the record. That matters for employment, housing, and any other situation that involves a background check. PC 1000 applies to a range of substances, including methamphetamine, heroin, cocaine, and certain prescription drug offenses.


Mental Health Diversion Under PC 1001.36

Penal Code 1001.36 extends diversion to defendants with qualifying mental health conditions when that condition played a meaningful role in the offense. Unlike PC 1000, it is not limited to simple possession and applies to a broad range of charges, including some felonies, which makes it worth evaluating even when other programs are off the table.

Common qualifying conditions include PTSD, bipolar disorder, schizophrenia, major depressive disorder, and anxiety disorders. A licensed mental health professional evaluates the defendant and prepares documentation connecting the diagnosis to the offense. 

The court considers five factors: a qualifying diagnosis, a significant connection between that diagnosis and the offense, a reasonable expectation of benefit from treatment, the defendant's consent, including waiving the right to a speedy trial, and no unreasonable risk to public safety.

If granted, proceedings pause for up to two years while the defendant completes a court-supervised treatment plan. Successful completion results in dismissed charges and a sealed arrest record. For most purposes, the defendant can truthfully state they were not arrested or convicted of the offense.
