Expungement After a Drug Conviction

Expungement After a Drug Conviction
By: Tammy Higgins | October 2, 2026 |

An old drug conviction in California can usually be dismissed under Penal Code 1203.4 once probation is done. That removes it as a barrier with most private employers. The petition is not automatic and it is not universal, so the paperwork has to be right the first time.

Our team files these across the San Gabriel Valley, and working with a reliable criminal defense attorney in West Covina gives your petition the best chance of being granted. Most clients are years past the case and only now blocked by it. The trigger is almost always the same. A background check came back and an offer went away.

What Penal Code 1203.4 Does to the Conviction

The statute lets you withdraw your guilty or no contest plea. You enter a not guilty plea and the court dismisses the case. The conviction is not erased from existence, though it is dismissed and the record shows that dismissal. A dismissed case and a live conviction are not the same thing on a report.

The practical effect lands in hiring. Most private employers in California cannot use a dismissed conviction against an applicant, and on most applications you can answer that you have not been convicted. That is the change people are buying with the petition. It is also why filing matters more than waiting, since the benefit arrives the day the order is signed.

Who Qualifies After a Drug Case

Eligibility runs on how the sentence was served, not on what the charge was called. The core requirements are short and the court applies them strictly.

  • Probation completed, or completed after any violation was resolved to the court's satisfaction
  • No state prison term on that conviction, the most common disqualifier on older felony drug cases
  • Not currently charged with another offense, serving a sentence, or on probation
  • All fines, fees, and restitution paid, or addressed with the court before filing
  • The conviction is not on the excluded list the statute keeps out entirely

Most drug convictions clear these without trouble, since possession and possession for sale cases usually end in probation rather than prison. Where a felony is in the way, a Penal Code 17(b) motion can reduce it to a misdemeanor. That motion often gets filed alongside the dismissal petition. The two together change what a report says far more than either one alone.

Had an offer pulled after a background check turned up an old Los Angeles County case? Give us a call at 909-306-5974 , and we will read the sentencing record and tell you whether a petition fits.

The Three Things Expungement Does not Fix

Accurate expectations save people from a bad decision here. A dismissal under 1203.4 does not wipe the record from law enforcement databases. Police, prosecutors and courts still see it, and it can still be used as a prior in a future case.

It does not restore firearm rights lost through a felony conviction.

That takes a separate route, such as a reduction to a misdemeanor or a pardon. And it does not undo immigration consequences the conviction has already triggered. Federal immigration law does not treat a state rehabilitative dismissal as erasing a conviction.

Non citizens need that answered by someone reading the actual plea transcript, and a Los Angeles expungement lawyer can walk through yours line by line before you file anything. State licensing boards also still see the dismissed case. A nursing or contractor application is a different analysis from a private job.

What Happens if the Case Ended in Diversion

Cases resolved through Penal Code 1000 diversion never produced a conviction, so there is nothing to expunge. The charge was already dismissed when the program ended. What remains is the arrest record, and that is handled through a different mechanism.

People mix these two up constantly, and it costs them filing fees and months of waiting. Say you finished a drug program years ago and a check still surfaces something. The problem is usually an arrest record or a reporting error.

Understanding expungement versus sealing records is the distinction that clears it up, and an attorney can point you to the right filing the first time. Pull your own record before filing anything. It is the cheapest step in the process and it often answers the question outright.

Why People File, and What Changes Afterward

The reasons repeat. A promotion that requires a fresh background check, a rental application in a tight market, a license renewal, a naturalization interview. The conviction sat harmlessly for a decade and then became the only obstacle.

What a dismissal changes is narrower than the advertising suggests, and still worth having. It strips the strongest version of the objection out of a private employer's file. It also lets you answer the conviction question honestly and favorably.

If you are weighing criminal records impacts in San Bernardino, an expungement lawyer can tell you in one conversation whether your case qualifies, because the answer sits in the sentencing record. If you are not sure what your record says, bring it in and let someone read it before you spend anything.

How Long the Process Takes

A straightforward petition usually moves in a few months from filing to hearing, though the calendar in each courthouse sets the pace. The court reviews the petition, the prosecution can object, and a judge signs the order or denies it. Nothing about the process requires you to appear in most routine cases.

Delay is the main thing that costs people. The petition can be filed as soon as probation ends, and there is no advantage to waiting for a rounder number of years. If a background check is already blocking something, say so in the paperwork, because courts do take the practical reason into account.

Where to Start

Pull your own record. The court file and your California record together show the disposition, the sentence and whether probation terminated cleanly. Those three facts decide the petition, and everything else is detail.

Tammy Higgins spent 16 years as a public defender in Orange County, Los Angeles County and San Bernardino County. Post conviction work has stayed part of what our firm does since. If your conviction came out of the West Covina Courthouse, or anywhere across Los Angeles County, bring the paperwork to our West Covina, California office. We will tell you plainly whether filing is worth your money, and we will say so if it is not.

Most of these conversations are short, because the record either shows probation completed with no prison term or it does not. Clients across West Covina, California and the surrounding cities usually walk out of that first meeting knowing exactly where they stand.

Frequently Asked Questions

How much does it cost to expunge a drug conviction?

It depends on how many cases you have and whether a felony reduction under Penal Code 17(b) needs to be filed alongside the petition. A single misdemeanor dismissal is simpler than a felony that needs reducing first. Once we've read your record, we'll tell you plainly whether filing is worth your money before you spend anything.

I have more than one old conviction. Can they all be addressed?

Each case is reviewed on its own, because eligibility depends on how each sentence was served. Some convictions may qualify right away, while others need a fine paid or a reduction filed first. Bring the paperwork for every case to one meeting, and we'll sort out which ones can move forward and in what order.

What if my petition is denied?

Denials usually come down to an eligibility issue, such as unpaid fines, probation that didn't terminate cleanly or a pending case. Depending on the reason, it may be possible to file again once that issue is resolved. Reviewing the record before filing is the best way to avoid a denial in the first place.

What happens after I reach out?

Pull your record if you can, or bring whatever paperwork you have to our West Covina office. We'll read the sentencing record, tell you whether you qualify and explain what a dismissal will and won't change for your situation. If filing makes sense, we'll prepare the petition and handle it through to the judge's order.

A dismissed conviction can remove the obstacle standing between you and a job, a lease or a promotion. Tammy Higgins and our team will review your record and give you a straight answer on whether expungement is the right step. Call 909-306-5974, we'll tell you plainly whether filing is worth it, and we'll say so if it isn't.
